These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services (collectively, the "Service") provided by The Adventure Society LLC ("we," "us," "our," or the "Company"), including Deal-i$h Dining.

By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of legal majority in your jurisdiction), you must have your parent's or guardian's permission. By using the Service, you represent that you meet these requirements.

3. License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not:

4. Subscriptions and billing

4.1 Subscription tiers

Deal-i$h Dining offers a free tier and one or more paid subscription tiers. Paid subscriptions are billed through Google Play (Android) or the Apple App Store (iOS) according to the pricing displayed in those stores.

4.2 Auto-renewal

Paid subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You can cancel at any time through your Google Play or Apple App Store account settings.

4.3 Free trials

We may offer a free trial for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged. Trial eligibility is one per user, per platform.

4.4 Refunds

All refund requests are handled by Google Play or the Apple App Store under their respective refund policies. We do not process refunds directly.

4.5 Price changes

We reserve the right to change subscription pricing. Existing subscribers will be notified of any price increase at least 30 days before it takes effect, and may cancel before the change applies.

5. Dietary information disclaimer

Important: Deal-i$h Dining generates recipes and identifies grocery deals using third-party AI models and publicly available information. While we make every effort to honor the dietary restrictions you specify (including allergies, intolerances, and religious requirements), we cannot guarantee 100% accuracy. The Service's recipe generation is software-based and may occasionally produce errors, omissions, or recipes that contain ingredients you have asked it to avoid.

You are solely responsible for verifying that all ingredients and recipes are safe for you to consume. Always read product labels and check ingredient lists at the store. If you have a serious allergy, intolerance, or medical condition, consult a qualified healthcare professional before relying on any meal-planning service.

The Service is not a substitute for medical advice, professional dietary planning, or careful personal verification of food ingredients. We disclaim all liability for any reaction, illness, or harm resulting from your reliance on recipes, deal listings, or dietary information generated or surfaced through the Service.

6. User content

The Service stores your meal plans, preferences, recipes, and shopping lists locally on your device. You retain all rights to that content. We do not have access to it and do not claim ownership.

If you contact us with feedback, suggestions, or ideas, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use that feedback to improve the Service, without obligation to compensate you.

7. Third-party services

The Service uses third-party providers (Google Firebase, Google Gemini API, Google AdMob, Google Play, Apple App Store). Your use of those services is also subject to their respective terms. We are not responsible for the acts, omissions, or content of third-party providers.

8. Intellectual property

The Service, including its software, design, branding, and content (other than your locally-stored content), is owned by The Adventure Society LLC and protected by copyright, trademark, and other laws. You may not use our branding or content without our written permission.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT RECIPES, DEALS, OR DIETARY DETERMINATIONS WILL BE ACCURATE OR RELIABLE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE ADVENTURE SOCIETY LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless The Adventure Society LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.

You may stop using the Service and delete your account at any time. See our Privacy Policy for account deletion procedures.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

You and The Adventure Society agree that any dispute will be resolved on an individual basis, and not as a class, collective, or representative action.

14. Changes to these Terms

We may update these Terms occasionally. When we do, we will update the "Last updated" date at the top. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance.

15. Miscellaneous

These Terms are the entire agreement between you and The Adventure Society regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of that provision.
